Terms of Service

These Terms of Service ("Terms") govern your access to and use of Patch Notes ("Service"), operated by GameSHLF LLC ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Patch Notes at https://usepatchnotes.com (the "Site"), creating an account, or using any features of the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be legally bound by them.

If you are using the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" apply to both you and that organization.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Patch Notes is a web-based developer utility provided by GameSHLF LLC that connects to GitHub repositories via the GitHub API, retrieves commit history within a user-defined range, and generates formatted release notes for distribution on platforms including the iOS App Store, Google Play Store, and web/markdown formats.

The Service includes:

  • GitHub Personal Access Token (PAT) vault for secure credential storage
  • Commit range selection and preview tooling
  • AI-assisted summarization of commit messages and pull request titles via OpenAI
  • Platform-specific output formatting (iOS, Google Play, Web/Markdown)
  • Public changelog pages hosted at your chosen URL
  • Release note history and export features

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable to you or any third party for any such changes.

3. Accounts & Registration

To use most features of the Service you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up-to-date.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Immediately notifying us of any unauthorized access to your account
  • Ensuring that you log out at the end of each session on shared devices

We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or have been inactive for an extended period, with reasonable prior notice where feasible.

4. Subscriptions & Payments

Plans & Credits

Patch Notes offers a free Trial tier and paid subscription plans (Basic, Pro) as well as a one-time Lifetime purchase. Plan details, pricing, and included release credits are described on the Pricing page at https://usepatchnotes.com/pricing and may be updated from time to time.

One "release credit" is consumed each time you click the Generate button and successfully generate release notes. Credits do not roll over between billing periods unless otherwise stated (e.g., the 75 bonus credits included with the Lifetime plan never expire).

Billing

Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. By providing a payment method, you authorize us (through Stripe) to charge you for the applicable plan. All fees are in USD and are non-refundable except as described below or as required by applicable law.

Cancellation & Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. We do not provide prorated refunds for partial billing periods.

For the Lifetime plan, refund requests must be made within 14 days of purchase and will be honored if you have used fewer than 5 release credits. After that window, all Lifetime purchases are final.

Price Changes

We may change subscription prices with at least 30 days' notice. Continued use of the Service after the price change constitutes your acceptance of the new pricing. If you do not agree to the change, you may cancel before the new pricing takes effect.

5. Acceptable Use

You agree to use Patch Notes only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to generate content that is unlawful, defamatory, harassing, abusive, fraudulent, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Service, its related systems, or any third-party services connected to it
  • Use automated tools, bots, or scripts to access the Service in a way that places excessive load on our infrastructure, beyond normal use
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
  • Share, resell, or sublicense your account access or API credentials to third parties
  • Use the Service to circumvent GitHub's terms of service or rate limits in a way that could harm GitHub or other users
  • Introduce malware, viruses, or other malicious code into the Service or connected systems
  • Impersonate any person or entity or falsely claim an affiliation with any person or entity
  • Use the Service to infringe upon the intellectual property rights of others
  • Engage in any activity that disrupts, damages, or impairs the Service or the experience of other users

Violation of this section may result in immediate suspension or termination of your account at our sole discretion, without refund.

6. GitHub Integration & Third-Party Services

Patch Notes integrates with GitHub via its public API. To use the integration features, you must provide a GitHub Personal Access Token (PAT) with the appropriate repository read permissions. By storing a PAT with our Service, you acknowledge and agree that:

  • Your use of the GitHub API is subject to GitHub's Terms of Service and acceptable use policies
  • You are solely responsible for ensuring that your PAT has only the permissions necessary for the Service to function (principle of least privilege)
  • We store your PAT encrypted at rest; however, you bear ultimate responsibility for the security of your GitHub credentials
  • You should revoke and regenerate your PAT immediately if you suspect it has been compromised
  • We are not affiliated with, endorsed by, or sponsored by GitHub, Inc.

The Service also uses OpenAI's API for AI-assisted summarization. Commit messages and pull request titles you select are transmitted to OpenAI for processing. By using the Generate feature, you consent to this data transfer. OpenAI's use of data is governed by their own privacy policy and terms. We do not use OpenAI to train models on your data.

Payment processing is handled by Stripe, Inc. Your payment information is transmitted directly to Stripe and is governed by Stripe's privacy policy and terms of service. We do not store your full payment card details on our systems.

Links to third-party websites or services are provided for convenience only. We have no control over third-party content and accept no responsibility for it.

7. Intellectual Property

Our IP

The Service, including its design, code, features, documentation, logos, and trademarks, is owned by or licensed to GameSHLF LLC and is protected by copyright, trademark, and other applicable laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.

Your Content

You retain ownership of the commit messages, pull request titles, and any other content you submit to the Service ("Your Content"). By using the Service, you grant GameSHLF LLC a limited, non-exclusive, royalty-free license to process, store, and display Your Content solely as necessary to provide and improve the Service.

You represent and warrant that you have all rights necessary to grant this license, and that Your Content does not infringe the intellectual property rights of any third party.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us an irrevocable, perpetual, worldwide, royalty-free license to use and incorporate that feedback without any obligation or compensation to you.

8. Data & Privacy

Our Privacy Policy (available at https://usepatchnotes.com/privacy) explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

Key data practices include:

  • GitHub PATs are encrypted at rest using industry-standard encryption and are only decrypted in memory at request time
  • We do not sell your personal data to third parties
  • Generated release notes are stored in your account history; you can delete individual notes or your account at any time
  • We use Supabase for database storage and authentication, which is hosted on infrastructure with SOC 2 compliance
  • We may collect anonymized, aggregated usage analytics to improve the Service
  • We comply with applicable data protection laws including, where applicable, GDPR and CCPA

You may request deletion of your account and associated data by contacting us at support@gameshlf.com. We will process deletion requests within 30 days.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMESHLF LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT GENERATED BY THE SERVICE, INCLUDING AI-GENERATED SUMMARIES
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS

AI-generated release notes are produced by large language models and may contain inaccuracies, omissions, or inappropriate content. You are solely responsible for reviewing, editing, and approving all generated content before publication. GameSHLF LLC accepts no liability for any consequences arising from publishing AI-generated content without review.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMESHLF LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless GameSHLF LLC, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you submit, generate, or publish using the Service
  • Your violation of any applicable law or regulation

12. Termination

You may terminate your account at any time by deleting it from your account settings or by contacting us at support@gameshlf.com. Termination does not entitle you to a refund of any prepaid fees, except as described in Section 4.

We may suspend or terminate your access to the Service immediately and without notice if we believe, in our sole discretion, that:

  • You have violated these Terms or any applicable law
  • Your account poses a security risk to the Service or other users
  • Your continued access would expose us to legal liability
  • We are required to do so by law or court order

Upon termination, your right to use the Service immediately ceases. We may delete your account data in accordance with our data retention policies, except where retention is required by law. Sections 7, 9, 10, 11, and 14 survive termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

  • Updating the 'Last updated' date at the top of this page
  • Sending an email notification to the address associated with your account
  • Displaying a prominent notice within the Service dashboard

Changes take effect 14 days after notification for material changes, or immediately for minor clarifications. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your account before the effective date.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. GameSHLF LLC is organized under the laws of Delaware.

For any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the matter informally by contacting us at support@gameshlf.com. We will make good-faith efforts to respond within 30 days.

If the dispute cannot be resolved informally, you and GameSHLF LLC agree to submit to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. Arbitration shall be conducted on an individual basis; class actions and class arbitrations are not permitted.

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
